मऊगंज जिले में ऐरा प्रथा के कारण आए दिन हो रही सड़क दुर्घटनाओं को रोकने एवं जन, पशु हानि तथा किसानों की फसलों के नुकसान को रोकने के उद्देश्य से कलेक्टर मऊगंज अजय श्रीवास्तव द्वारा धारा 144 के तहत आदेश जारी किये गये हैं।

मऊगंज जिले की राजस्व सीमा अन्तर्गत कोई भी पशुपालक अपने पशुओं को आवारा खुला नही छोडेगा । यदि कोई पशुपालक ऐसा करते हुए पाया जाता है जिससे सडक दुर्घटना के कारण पशु की मृत्यु होती है या जनहानि होती है तो उसके विरूद्ध पशु अतिचार अधिनियम व लोक परिशांति भंग होने की स्थिति के कारण दंड प्रक्रिया संहिता मे विहित विधान अंतर्गत कार्यवाही की जाएगी।

सडकों पर आवारा भ्रमण करते हुए पशुओं एवं ग्रामीण क्षेत्र में विचरण करते हुए पशुओं के तात्कालिक व्यवस्था हेतु जिले की तीनों नगर परिषदों में मुख्य नगर पालिका अधिकारी एवं ग्रामीण क्षेत्र में सभी मुख्य कार्यपालन अधिकारी जनपद पंचायत अस्थायी बाडों का निर्माण कर आवारा पशुओं को बाड़े में रखेंगे तथा उनके लिए पानी एवं चारे की समुचित व्यवस्था करेंगें।

किसी प्रकार के उल्लंघन के लिए उपरि वर्णित अधिकारी उत्तरदायी होंगें। यदि कोई पशुपालक यह दावा करता है कि बाडे मे अवरोधित पशु उसका है और वह उसे घर ले जाना चाहता है तो प्राधिकृत अधिकारी के द्वारा प्रति पशु 1000/- अर्थदंड अधिरोपित कर इस आशय का शपथ पत्र लेकर कि अब पशुपालक के द्वारा अपने घर पर रखा जाएगा खुला नहीं छोड़ा जाएगा-पशु ले जाने की अनुज्ञा प्राधिकृत अधिकारी के द्वारा प्रदाय की जाएगी। जिले की तीनों नगर परिषदों के मुख्य नगर पालिका अधिकारी एवं ग्रामीण क्षेत्र में सभी मुख्य कार्यपालन अधिकारी जनपद पंचायत प्राधिकृत अधिकारी होंगे।

यदि कोई नागरिक पशु सेवा हेतु स्वेच्छा से पशुओं का अपने घर ले जाकर पालन पोषण करना चाहता है तो ले जा सकता है। किंतु पशु पालक द्वारा दावा करने पर नियमानुसार पशुपालक को उसका पशु वापस करना होगा। यह आदेश 20 सितंबर 2023 की मध्य रात्रि से 19 दिसंबर 2023 तक प्रभावाशील रहेगा। उपरोक्त निर्देशों का उल्लंघन भारतीय दण्ड सहिता 1860 के सुसंगत प्रावधानों के अन्तर्गत दण्डनीय रहेगा

Collector Mauganj imposed section 144 for proper management of stray animals

Orders have been issued under Section 144 by Collector Mauganj Ajay Srivastava with the aim of preventing road accidents happening every day due to Aira practice in Mauganj district and to prevent loss of life, animals and farmers’ crops.

Within the revenue limits of Mauganj district, no animal farmer will leave his animals roaming free. If any animal keeper is found doing something which leads to the death of an animal or loss of life due to a road accident, then action will be taken against him under the provisions of the Animal Trespass Act and the provisions of the Code of Criminal Procedure due to violation of public peace.

For the immediate arrangement of the animals wandering on the roads and in the rural areas, the Chief Municipal Officer in the three Municipal Councils of the district and all the Chief Executive Officers of the District Panchayat in the rural areas will construct temporary fences and keep the stray animals in the enclosure. And we will make proper arrangements for water and fodder for them. The officers mentioned above will be responsible for any kind of violation.

If an animal owner claims that the animal blocked in the enclosure is his and he wants to take it home, then the authorized officer will impose a fine of Rs 1000/- per animal and take an affidavit to the effect that the animal owner will now keep it at his home. Will not be left open – Permission to take the animal will be given by the authorized officer.

The Chief Municipal Officers of the three Municipal Councils of the district and all the Chief Executive Officers in rural areas will be Janpad Panchayat authorized officers.
If any citizen wants to voluntarily take animals to his home and nurture them for animal service, he can do so. But if the animal owner makes a claim, as per the rules the animal owner will have to return his animal.

This order will be effective from midnight of 20 September 2023 to 19 December 2023. Violation of the above instructions will be punishable under the relevant provisions of the Indian Penal Code, 1860.
